This End User License Agreement ("EULA") is a legal agreement between you and Filip Ruzicka ("Developer", "we", "us", "our"), and not with Apple Inc. ("Apple"). The Developer, not Apple, is solely responsible for BiteCam ("the app", "the Licensed Application") and its content.
By downloading, installing, or using BiteCam ("the app", "the service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the app.
BiteCam is operated by Filip Ruzicka, based in the Czech Republic.
The license granted to you for BiteCam is limited to a non-transferable license to use the app on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use BiteCam on any device that you do not own or control, and you may not distribute or make BiteCam available over a network where it could be used by multiple devices at the same time.

To use BiteCam, you must create an account using Sign in with Apple or an email address and password. You are responsible for:
You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement.
BiteCam offers a free tier and paid subscription plans:

Subscriptions are billed through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions. Refunds are handled by Apple according to their refund policy.
We reserve the right to change pricing with at least 30 days' notice. Price changes will not affect active subscription periods.
BiteCam, including all its features, data, and AI-generated content, is not guaranteed to be accurate, complete, or error-free. The application and all information it provides are offered on an "as is" basis.
Our AI vision technology analyzes photos to identify food items and estimate nutritional content. However:
You use BiteCam and rely on its data entirely at your own risk. The developer assumes no responsibility or liability for any decisions you make based on information provided by the app. You may adjust portions and nutritional values manually after each scan. We strongly recommend using BiteCam as a general guide rather than relying on it for precise dietary calculations.
BiteCam is not a medical device and does not provide medical advice. The app is intended for general wellness and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
You agree not to:
We reserve the right to suspend or terminate accounts that violate these rules.
When you use BiteCam, you may submit content including food photos, meal descriptions, and other data ("User Content"). By submitting User Content, you acknowledge and agree that:
We will never sell your identifiable photos or personal data to third parties. Photos are processed securely and access is limited to automated systems providing the service.
All content, features, and functionality of BiteCam — including the app design, code, AI models, branding, and documentation — are owned by Filip Ruzicka and are protected by intellectual property laws.
The BiteCam name, logo, and related marks are trademarks. You may not use them without prior written permission.
By you: You may delete your account at any time through the app's Profile screen or by contacting us. Upon deletion, your data will be permanently removed from our servers within 30 days.
By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. We will provide notice unless immediate action is necessary to protect the service or other users.
Upon termination, your right to use the service ceases immediately. Sections on intellectual property, limitation of liability, indemnification, and governing law survive termination.
Filip Ruzicka is solely responsible for providing any maintenance and support services with respect to BiteCam, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to BiteCam.
To the maximum extent permitted by applicable law:
Nothing in these Terms limits liability for fraud, gross negligence, or anything that cannot be excluded by law.
In the event of any failure of BiteCam to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to BiteCam, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of the Developer.
Filip Ruzicka, not Apple, is responsible for addressing any claims by you or any third party relating to BiteCam or your possession and/or use of BiteCam, including but not limited to: (i) product liability claims; (ii) any claim that BiteCam fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Filip Ruzicka, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any intellectual property infringement claim related to BiteCam.
You agree to indemnify and hold harmless Filip Ruzicka and BiteCam from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service or violation of these Terms.
These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the Czech Republic.
If you are a consumer in the European Union, you also enjoy the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in your local courts.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 30 days before the changes take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms.
